These Terms of Use ("Terms") govern your access to and use of this website and the services of 5D Wellness. By using the site or our services, you agree to these Terms. If you do not agree, do not use the site or our services.
Eligibility
You must be at least 18 years old (or have the consent and supervision of a parent or legal guardian) to purchase memberships, book services, or use our facilities.
Memberships and billing
Memberships are billed through OfficeRnD on a recurring basis (for example, monthly) until cancelled in accordance with your membership agreement. A one-time enrollment fee may apply. Prices, promotions, and benefits are subject to change, and promotions are time-limited.
By enrolling, you authorize recurring charges to your payment method on file until you cancel. You are responsible for keeping your payment information current.
Cancellations and refunds
Membership cancellations follow the terms of your membership agreement. Day passes, packages, and gift cards may be non-refundable except where required by law. Massage and tour appointments require at least 24 hours' notice to avoid a cancellation fee.
Bookings, passes, and gift cards
Massages and tours are by appointment through Square and are subject to availability and any deposit, cancellation, or no-show policy presented at booking. Day passes are valid as stated at purchase. Gift cards are non-refundable and cannot be redeemed for cash except where required by law.
Facility access and rules
Members receive secure 24/7 key-fob/app access for their own use only. Sharing access credentials or admitting non-paying guests ('tailgating') is prohibited and may incur fees and termination of membership. You must follow all posted guidelines and staff instructions at all times.
Health, safety, and assumption of risk
Our therapies — including infrared sauna, red light therapy, cold plunge, contrast therapy, halotherapy, BioAcoustic crystal mat, tanning, and massage — involve heat, cold, light, and physical contact and carry inherent risks. You represent that you are physically able to use them and have consulted a physician where appropriate.
To the fullest extent permitted by law, you voluntarily assume all risks associated with use of our facilities and services and release and hold harmless 5D Wellness, its owners, employees, and contractors from claims arising out of such use, except for liability that cannot be waived by law.
Intellectual property
All content on this website — text, graphics, logos, and images — is owned by 5D Wellness or its licensors and is protected by law. You may not copy, reproduce, or use any content without our prior written consent.
Prohibited conduct
You agree not to misuse the site or services, including by attempting to gain unauthorized access, interfering with operation, infringing others' rights, or using the services for unlawful purposes.
Third-party services
Memberships, payments, and bookings are processed by third parties (OfficeRnD, Square). Your use of those services is also governed by their terms and privacy policies, which we do not control.
Disclaimer of warranties
The website and services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, 5D Wellness and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the website, facilities, or services. Where liability cannot be excluded, it is limited to the amount you paid us in the three months before the claim.
Indemnification
You agree to indemnify and hold harmless 5D Wellness from any claims, damages, or expenses arising out of your use of the services, your violation of these Terms, or your violation of any rights of another.
Governing law and disputes
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Minnesota, and you consent to their jurisdiction.
Changes, severability, and contact
